The 2023 Royal Canadian Geographical Society Polar Plunge
Release and Indemnity
Background
- The Royal Canadian Geographical Society Polar Plunge (the “RCGS Polar Plunge”) is an event in which participants plunge into frigid bodies of water in order to attract attention to and raise funds in support of the work of the Royal Canadian Geographical Society.
- This Release and Indemnity is granted and addressed by the undersigned to and in favour of the following parties:
- The Royal Canadian Geographical Society, Canadian Geographic Enterprises, Canadian Geographic Education, and all of their affiliates, administrators, members, shareholders, governors, directors, agents, officers, employees, and volunteers;
- other participants in the RCGS Polar Plunge;
- any and all sponsors and advertisers of the RCGS Polar Plunge;
- any and all owners, lessees, and licensees of premises on or through which the RCGS Polar Plunge takes place, including any persons granting access to such premises,
and the above parties are collectively referred to as the “Releasees”.
- I, the undersigned, am granting this Release and Indemnity as a condition of my being permitted by the Releasees to participate in the RCGS Polar Plunge.
Assumption of Risk
- I, the undersigned, acknowledge and confirm to the Releasees as follows:
- I understand the nature of the RCGS Polar Plunge, I have full legal capacity, I am in good health, and I am physically fit to participate in the RCGS Polar Plunge;
- I understand that participation in the RCGS Polar Plunge involves risks of serious bodily injury, including permanent disability, paralysis, and death and that such injury and death may arise as a result of the nature of the activity itself, my own actions or inactions, or the actions or inactions of the Releasees, including (without limitation) the Releasees’ negligence or other fault;
- there may also be other risks associated with my participation in the RCGS Polar Plunge which are currently not known to me or not foreseeable at this time.
- I fully accept and assume all risks and dangers which may arise as a result of my participation in the RCGS Polar Plunge.
Release and Indemnity
- I hereby release, discharge, and covenant not to sue the Releasees from and in respect of any claims, demands, losses, costs, damages, or other liability of any sort (“Claims”) arising from or alleged to arise from my participation in the RCGS Polar Plunge.
- Without limiting the foregoing, I hereby release, discharge, covenant not to sue the Releasees from and in respect of any Claims arising from or alleged to arise from the negligence or other fault of the Releasees in the conduct of the RCGS Polar Plunge.
- I further agree and covenant that if any person asserts a Claim against any of the Releasees in connection with my participation in the RCGS Polar Plunge, I will indemnify and hold harmless each of the Releasees in respect of such Claim.
Knowledge and Consent
- I have read and understood this Release and Indemnity, and I am signing it freely and without any coercion or undue influence of any nature and intend it to be a complete and unconditional release and indemnity of all liability related to my participation in the RCGS Polar Plunge to the greatest extent allowed by law and agree that if any portion of this Release and Indemnity is held to be invalid, the balance of this document shall nonetheless continue in full force and effect. This Release and Indemnity may be executed and delivered in electronic form.
- I have have had the opportunity to obtain legal advice. I understand that by signing and granting this Release and Indemnity I am giving up substantial rights.
- I consent to and permit emergency treatment in the event of illness or injury.
- I grant The Royal Canadian Geographical Society permission to use my name, picture, voice, and words in television, radio, films, newspaper, magazines, and other media, and in any other form not heretofore described for the purpose of advertising and fundraising to support The Royal Canadian Geographical Society.
IN WITNESS WHEREOF, I have executed this Release and Indemnity under seal on this day.
